We Can't Even Steal From A Thief !


 

 

Did you know that under the principals of property law, Thief One (referred to as a converter) can sue Thief Two (who stole from Thief One) to recover the very goods Thief One stole from an innocent third party victim? 

 

Consider the nationally recognized case of Anderson v. Gouldberg, Minn. Sup. Ct., Minn. 294, 53 N.W. 636 (1892). In this case Anderson, a woodcutter wrongfully trespassed upon the land of another, removed logs from the land, marked them with his initials and brought these logs to a lumber mill. Gouldberg thereupon took the logs and Anderson sued Gouldberg for conversion. The court held that possession is good against all except those who have better title. In this case better title (than Anderson’s title) could be shown only by the actual innocent third party victim.
